| Governor DeSantis Issued Executive Order – Language Required in Roofing Contracts The Governor’s Executive Order #24-208, signed at 12 pm today, enacts a law that roofing contractors MUST include the 10-Day Contract Cancellation Notice in your contracts for the next 60 days if you do work in the following counties: Alachua, Bay, Bradford, Calhoun, Charlotte, Citrus, Collier, Columbia, Dixie, Escambia, Franklin, Gadsden, Gilchrist, Gulf, Hamilton, Hernando, Hillsborough, Holmes, Jackson, Jefferson, Lafayette, Lee, Leon, Levy, Liberty, Madison, Manatee, Marion, Monroe, Okaloosa, Pasco, Pinellas, Santa Rosa, Sarasota, Sumter, Suwannee, Taylor, Union, Wakulla, Walton, and Washington counties. We anticipate that this may change later in the week to include more counties. 10-Day Contract Cancellation Notice Language: You, the residential property owner, may cancel this contract without penalty or obligation within 10 days after the execution of the contract or by the official start date, whichever comes first, because this contract was entered into during a declaration of a state of emergency by the Governor. The official start date is the date on which work that includes the installation of materials that will be included in the final work on the roof commences, a final permit has been issued, or a temporary repair to the roof covering or roof system has been made in compliance with the Florida Building Code. In addition, contractors who execute roofing contracts during a declared state of emergency must include the language above in bold type, no less than 18 points in size. This statement must appear in the contract or as an attachment and be placed immediately before the space intended for the homeowner’s signature. All of this is based on HB 939 – Consumer Protection that was signed into law and went into effect on July 1st, 2024 that states during a State of Emergency, roofers will need to add this wording to their contracts.
